1. Acceptance of Terms

By accessing and using FitOut Insider ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service. FitOut Insider is operated by Dariusz Kubies ("we", "us", "our").

2. Nature of the Service

FitOut Insider provides AI-powered document generation and analysis tools for the UK fit-out and construction industry. The Service is designed to assist qualified professionals in creating draft documents, checklists, registers, programmes, and plans. All outputs are generated using artificial intelligence and are provided for guidance and reference purposes only.

3. Guidance Only — No Professional Advice

IMPORTANT: All outputs generated by FitOut Insider tools are for guidance and reference purposes only. They do not constitute, and must not be relied upon as, professional health and safety advice, legal advice, engineering advice, or commercial advice of any kind. Health and safety tools (including but not limited to RAMS, Fire Risk Assessments, Permit to Work, Scaffold Inspection, Temporary Works, CDM notifications, and LOLER assessments) produce AI-generated draft documents only. These drafts must always be reviewed, validated, and approved by a competent person or suitably qualified professional before use on any live project. Reliance on unreviewed AI output for health and safety compliance may create legal liability. You must always have all outputs reviewed by a suitably qualified professional before use on any live project, tender, or submission. FitOut Insider accepts no responsibility for the accuracy, completeness, or suitability of any tool output for any specific purpose.

4. User Responsibilities

You are solely responsible for: (a) Ensuring all outputs are reviewed and verified by qualified professionals before use (b) Ensuring compliance with all applicable laws, regulations, and contractual obligations, including the Health and Safety at Work Act 1974, CDM 2015, and all relevant industry regulations (c) Maintaining the accuracy of any data you input (d) Not using the Service for any unlawful purpose (e) Ensuring that use of AI-generated content complies with any applicable professional standards, client contracts, or regulatory requirements (f) Not attempting to reverse-engineer, scrape, or systematically extract the Service's tools, prompts, or outputs for commercial redistribution (g) Not using the Service to generate content that is misleading, fraudulent, or intended to deceive any person or regulatory body

5. Subscriptions and Payment

Access to the Service requires a paid subscription. Subscriptions are billed monthly or annually as selected at checkout. All payments are processed by Stripe. You may cancel at any time from your account settings — your subscription continues until the end of the current billing period. All plans include a 7-day money-back guarantee. Contact hello@fitoutinsider.com within 7 days of your initial subscription to request a full refund.

6. AI Request Allowances

Each subscription plan includes a monthly AI request allowance (Solo: 50 requests/month; Professional: 150 requests/month). Requests reset at the start of each billing period. Additional requests can be purchased as bolt-ons from your account settings. Unused requests and bolt-ons do not roll over to the following month.

7. Limitation of Liability

To the fullest extent permitted by applicable law, FitOut Insider, its operators, and its affiliates shall not be liable for: (a) any loss, damage, injury, death, or financial loss arising from reliance on any tool output; (b) any direct, indirect, incidental, special, or consequential damages; (c) any failure to meet any specific regulatory, contractual, or professional standard. This limitation applies regardless of whether liability is alleged in contract, tort (including negligence), breach of statutory duty, or otherwise. Indemnification: You agree to indemnify, defend, and hold harmless FitOut Insider and its operators from any claims, losses, damages, costs, or expenses (including legal fees) arising from: (i) your use or misuse of the Service; (ii) your violation of these Terms; (iii) any third-party claim arising from content you generate, submit, or share using the Service.

8. Intellectual Property

The FitOut Insider platform, including its design, code, and underlying tool structure, is the intellectual property of Dariusz Kubies. You retain ownership of any project-specific data you input. Tool outputs generated through the Service may be used freely for your professional purposes, subject to Clause 3. You may not reproduce, distribute, or commercially exploit the platform or its tools without written permission.

9. AI-Generated Content

Outputs are generated by AI language models (Anthropic Claude). AI outputs may contain inaccuracies, omissions, outdated information, or errors. The construction and fit-out industry is subject to frequent legislative and regulatory changes. You must verify that all outputs reflect the current applicable legislation, regulations, and contractual frameworks relevant to your project.

10. No Warranty

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Where changes are material, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after that period constitutes your acceptance of the revised Terms. The date of the most recent revision is noted at the top of this page.

12. Governing Law

Before commencing formal legal proceedings, the parties agree to attempt to resolve any dispute in good faith through direct negotiation for a period of 30 days. If unresolved, either party may refer the dispute to mediation under the CEDR (Centre for Effective Dispute Resolution) Model Mediation Procedure or, by agreement, the RICS Dispute Resolution Service. The costs of mediation shall be shared equally unless otherwise agreed. If mediation fails or is refused, these Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Force Majeure

FitOut Insider shall not be liable for any failure or delay in performance of the Service resulting from causes beyond our reasonable control, including but not limited to acts of God, third-party infrastructure failures (including cloud hosting or AI API outages), cyberattacks, or changes in applicable law or regulation.
